Terms of Service

The agreement that governs your use of UpMinute, including subscriptions, acceptable use, and our health disclaimer.

These Terms of Service ("Terms") govern your use of the UpMinute mobile application and related services (the "Service") operated by UpMinute ("we," "us," "our").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

UpMinute provides mood tracking, guided micro-sessions (such as breathing, movement, mindfulness, and visualization), streaks, reminders, and related wellness features. Some features are free; others require a paid UpMinute Premium subscription.

2. Health disclaimer — please read

UpMinute is a general wellness product. It is not a medical device, does not provide medical or mental-health advice, diagnosis, or treatment, and is not a substitute for care from a qualified professional.

  • Never disregard professional advice or delay seeking it because of something in the app.
  • If you are experiencing a mental-health crisis or thoughts of self-harm, contact local emergency services or a crisis helpline immediately.
  • Consult a physician before starting movement or breathing exercises if you have a medical condition.

3. Your account

  • You must be at least 13 years old to use the Service.
  • You sign in with Google or Apple; you are responsible for keeping access to that account secure.
  • Provide accurate information and keep it up to date.
  • You are responsible for activity that happens under your account.

4. Subscriptions and billing

  • UpMinute Premium is offered as auto-renewing monthly and yearly subscriptions, billed through Google Play or the Apple App Store.
  • Prices are shown in the store's checkout before you pay and may vary by region.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your Google Play or App Store account settings — deleting the app does not cancel a subscription.
  • Refunds are handled by Google Play and Apple under their policies. Where we can lawfully assist with a refund request, contact support@upminute.app.
  • Free trials or introductory offers, when available, convert to a paid subscription unless cancelled before the trial ends.

5. Acceptable use

You agree not to:

  • reverse engineer, copy, resell, or exploit the Service or its content;
  • use the Service in any unlawful way or in violation of these Terms;
  • attempt to probe, breach, or overload our systems or interfere with other users;
  • use automated means to access the Service without our written permission.

6. Your content

You keep ownership of the content you create in the app (notes, goals, check-ins). You grant us a limited license to store and process that content solely to provide the Service to you. We do not publish your content or use it for advertising.

7. Our intellectual property

The Service — including session content, audio, graphics, branding, and software — belongs to UpMinute or its licensors and is protected by intellectual-property laws. These Terms grant you a personal, non-exclusive, non-transferable, revocable license to use the app on your own devices.

8. Termination

You can stop using the Service and delete your account (email support@upminute.app) at any time. We may suspend or terminate accounts that violate these Terms, harm the Service or other users, or where required by law. Sections that by their nature survive termination (disclaimers, limitations of liability, governing law) survive.

9. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results (including mood or wellness outcomes) will be achieved.

10. Limitation of liability

To the maximum extent permitted by law, UpMinute will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Changes to the Service or Terms

We may modify the Service or these Terms. For material changes we will give notice in the app or by email. Continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service and delete your account.

12. Governing law

These Terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts of India, without prejudice to mandatory consumer protections in your country of residence.
